In this section, we are seeking responses that reflect the four ratings criteria: involvement, effectiveness, character, and knowledge.  These are defined as follows:

 

  • Involvement: What has the candidate done previously in family, neighborhood, community, volunteer work, employment or public life to suggest readiness to accomplish challenging objectives? How do these activities demonstrate readiness for the challenges unique to the office sought?

 

  • Effectiveness: Has the candidate demonstrated promise of being productive in the office sought?  Has the candidate shown the ability to work with other people?

 

  • Character: Do the candidate's personal traits show the ability to take on the responsibilities of campaigning for and holding the public office she or he is seeking? Is the candidate a leader, participant or observer?  Is the candidate trustworthy, reliable and candid?

During the coming year, we will file 27,000 felony criminal cases in our state.  Criminal cases represent the largest single type of written opinion issued by our Supreme Court.  These cases have a profound impact on the accused, victims and our communities.  I believe that my commitment to justice and decades of experience serving the people, in the area of criminal law, will assist the Court to act fairly and impartially to serve all the people, not just narrow interests.  I believe that our deep commitment to law, including our constitution, helps define us as a people.  The Supreme Court, an indespensible component of our constitutional system, can only operate fairly and impartially to define our constitution and laws, while respecting the role of the legislature and executive office.  I would also bring a respect for judicial precedent, fairness, equality and justice.  I would not bring individual, personal, narrow-minded idealogy to the Court. 

 


 

2.      Describe your most important personal characteristics or traits as they relate to the office you seek.

 

In 1951, I was born to a mixed-blood Sioux family in a Bureau of Indain Affairs Hospital on the Pine Ridge Indian Reservation.  I was raised by extended family, primarily by my grandmother, Ethel Merrival, in the midst of our nation's worst poverty, racial hostility and governmental neglect.  My grandmother, a leader within the Tribe, served as Tribal Secretary and tribal attorney.  At her side during my youth, I observed and learned leadership, courage and responsibility.  I was also inspired by a young, idealistic catholic priest, and together, my education and legal career demonstrated that the strength of the human spirit, work and commitment can overcome the cycle of poverty, ignorance and hatred. I have witnessed and felt the consequences of violence, discrimination, and the failure of governmental leadership.  I am uniqely prepared to understand and protect all people from the government, the violent criminal offender, and the powerful who seek to profit unfairly at the expense of others.  Although I take great pride in bringing honor to my people, I also attempt to serve as an example for other members, especially younger, of my family and Tribe.  My wife and I are in the process of adopting a distant cousin, a parentless 8 year old girl from my reservation. 

 

In addition to my life experiences, my service to the public includes 22 years as a deputy prosecuting attorney, and 5 years as a special assistant United States attorney.  I have worked for all the people, all the victims, as a prosecutor to seek justice.  I have prosecuted some of the most serious muderers, violent criminal, drug offenders and white collar criminals.  I have handlesd over 6000 felony cases.  I also served 2 years as counsel for the Puyallup and Chehalis Tribes and 1 year in domestic peace corps at Milwaukee Legal Services.  During law school, I assisted in the representation of indigent Native Americans and the Menominee Tribe.

 

3.      Please describe in sufficient detail, one to three accomplishments or contributions of which you are most proud.  These examples should illustrate effective skills and capabilities you think apply to the office you are seeking.  These accomplishments may have occurred at any time in your personal, professional, or public life. 

 

I take great satisfaction from my widespread reputation among the Pierce County bar for fairness, integrity and ethical conduct.  I believe that most, if not all attorneys who have handled cases with me confirm that I am known more for the trust that I have maintained as opposed to the power that I have weilded as a public servant on behalf of the government.  I am also proud of my exemplary record as a special assistant U.S. attorney.  For five years, I practiced effectively and fairly before federal trial and appellate courts.  Please feel free to contact the Federal Public Defenders office to confirm this at 253-593-6710.  My supervisor was William Redkey who can be reached at 205-553-1206.  For several years, I acted as a felony case negotiator for the Pierce County Prosecutor's Office.  During that time I negotiated thousands upon thousands of cases which would otherwise have required untold resources if they were tried before juries.  In addition to saving the cost of these trials, I was satisfied that these negotiated resolutions represented justice as applied to the parties before the courts.


 

4.      Please list or describe your current and past activities in the community in which you have acquired skills that relate to the office you seek.  Include your role in the activity and the year(s) in which you were involved.  Involvement consists of many areas such as family, neighborhood, community, employment, or public life.

 

For over two decades I have protected the rights of all the people and sought justice as a lawyer serving the public.  I have protected the rights of ordinary citizens to be secure in the their persons, homes and communities.  I have prosecuted some of the greatest threats to our safety: murders, violent criminals, serious drug offenders and white collar criminals who believed that they were above the law.  As an officer of the Supreme Court, in a quasijudicial capacity, I have also jealously guarded the rights of the innocent to be free from government misconduct.  I have worked hard to maintain the trust that the people have placed in me.

 

 

  1. Please describe the duties of the office you seek.  Which are the most important duties and why?

 

The Supreme Court operates as an indispensible branch of our constitutional system to rely on existing precedent and reasoned analysis to interpret the constitution and apply the law.  The most important function of the Court is to fairly and impartially apply the constitution and laws, while respecting the role of other branches of the government and the rights of the people.  In this capacity, the Court protects the people from overeaching by the executive and legislative branches of the government.  Supreme Court Justices are not affiliated with any existing political party or economic interest, and have a duty to serve all the people, as opposed to any narrow interest.  Given the Court's role and the nature of the matters brought before it, it is essential that the Court function impartially and fairly in order to maintain the confidence, trust and respect of all the people.

1.   Briefly describe the nature of your current practice/position including types of clients and areas, if any, of specialization.  State what percentage involves civil litigation, criminal litigation, and/or nonlitigation.

 

 Currently, I am assigned to the juvenile division of Pierce County Prosecutor's Office. The majority of these criminal cases involve the likelihood of trial as a last resort.  I work hard to insure that each individual case is handled fairly to benefit all the involved parties, including the victims and defendants.  I work hard to insure that the system works to assist juvenile offenders accept responsibility for their actions, learn from their mistakes and become productive adult members of our communities.

 

2.   Identify all your experience as a neutral decision maker (e.g. judge, permanent or pro tem, in any jurisdiction, administrative law judge, hearing officer, arbitrator, etc.)

 

 As a deputy prosecuting attorney and special assistant United States attorney, responsible for seeking justice, I have acted as a quasijudicial officer of the court.  In this capacity, I have exercised discretion in filing and resolving criminal cases on behalf of all the people, including the accused. I have earned widespread respect from my peers, even those who oppose me in court.
