In this section, we are seeking responses that reflect the four ratings criteria: involvement, effectiveness, character, and knowledge.  These are defined as follows:

 

  • Involvement: What has the candidate done previously in family, neighborhood, community, volunteer work, employment or public life to suggest readiness to accomplish challenging objectives? How do these activities demonstrate readiness for the challenges unique to the office sought?

 

  • Effectiveness: Has the candidate demonstrated promise of being productive in the office sought?  Has the candidate shown the ability to work with other people?

 

  • Character: Do the candidate's personal traits show the ability to take on the responsibilities of campaigning for and holding the public office she or he is seeking? Is the candidate a leader, participant or observer?  Is the candidate trustworthy, reliable and candid?

I appear in court daily and have tried hundreds of cases over the past 27 years.  My career in Washington began with the Snohomish County Public Defender's Office.  After a little more than one year, I was appointed to be the Director of the Office.  After leaving the public defender's office to open a private practice, I continued to accept court appointed cases.  My legal practice brings me in contact with a cross section of our community ranging from the improvished to the affluent.  I represent people, not companies, and feel that my experience has made me particularly mindful of the obligations of the court to ensure justice to all those who come before it. 

In the last several years I have begun to lecture more frequently at Continuing Legal Education Seminars.  My presentations are favorably received.  My proficiency as a trial attorney has resulted in my being listed in America's Best Lawyers, Seattle's Best Lawyers, and Law and Politics Super Lawyers.     

 


 

2.      Describe your most important personal characteristics or traits as they relate to the office you seek.

 

My most important trait is my willingness to work hard.  Representing clients requires hard work, and I have done this for many years.  From this, I have developed competence as a lawyer and in particular a trial lawyer.  I know what it takes to be a good judge because I have spent so many years in courtrooms all over the State.  I have been recognized by America's Best Lawyers, Seattle's Best Lawyers, and Law and Politics Super Lawyers as one of the best lawyers in my primary field of practice. It is this determination that will distinguish me as a judicial candidate and as a judge. 

 

3.      Please describe in sufficient detail, one to three accomplishments or contributions of which you are most proud.  These examples should illustrate effective skills and capabilities you think apply to the office you are seeking.  These accomplishments may have occurred at any time in your personal, professional, or public life. 

 

I am proud that I have been continually included in numerous publications, both locally and nationally, as one of the best lawyers in my field.  I am proud that my hard work on behalf of my clients is appreciated, first by my clients, and second by the community.  Part of the reason for my inclusion could be that I have litigated precedant setting issues in front of the Washington Supreme Court and the Court of Appeals.  I have litigated the Fourth Amendment's search and seizure provision as it related to the use of thermal imaging and drug sniffing dogs.  These cases helped establish for each of us our right to protection from unwarranted government intrusion. 

 

What I am most proud of, however, is my two children.  I am proud that I was able to help raise children that are well balanced, as people, students, and athletes.  My children have taught me far more patience than I ever thougt possible or necessary.  By parenting, I was able to empathize with the many issues that judges must decide on a daily basis. 


 

4.      Please list or describe your current and past activities in the community in which you have acquired skills that relate to the office you seek.  Include your role in the activity and the year(s) in which you were involved.  Involvement consists of many areas such as family, neighborhood, community, employment, or public life.

 

My primary activities have always been working hard, helping to support my family, and helping to raise my two children.   I have been involved in all their numerous sporting activities and academic accomplishments.  I believe that every involvement with the community, in any regard, relates to the position of judge.  Being a good judge requires solving problems within the parameters of the law.  Being a good parent, being a sole practitioner running a successful law firm, and being a good lawyer all relate to problem solving on some level. 

 

 

  1. Please describe the duties of the office you seek.  Which are the most important duties and why?

 

The primary duty of a judge is to make certain that equal justice is available to all who enter the courtroom.  To fulfill this duty the Judge must be knowledgeable, impartial and motivated to ensure that each litigant is treated fairly and given an opportunity to present his or her case.  A secondary responsibility of the judiciary is to ensure that the justice system is efficient.  As a long time participant in the criminal justice system, I know that it is far from efficient.  This lack of efficiency serves to erode the public's confidence in the system.  The judges of the Superior Court can and should take steps to make the system more efficient.  If elected I would work with my fellow judges to implement changes in the Court rules that I believe would benefit the administration of justice.

 My practice primarily involves criminal defense.  I represent private clients in the State and Federal Courts in Washington.  Perhaps 95% of my caseload is criminal litigation.  The remaining 5% of my practice is civil litigation.  I represent plaintiffs and defendants in personal injury cases and plaintiffs in civil rights litigation.

  Yes, I was reprimanded by the Washington State Bar Association for representing more than one party in a related matter without obtaining a written waiver.  The conflict occurred in approximately 1994 and the reprimand was issued in approximately February, 2002.
